Terms of Service

Introduction

Tickets 4 Fans (“we”, “us”, “our”) provides a platform for season seat holders and fans to connect and exchange tickets for sporting events, including Toronto Raptors, Toronto Blue Jays, Toronto FC, and Toronto Tempo, with plans to expand to other Toronto sports and events. We may also operate related subdomains and fan-engagement features, including Cup Pass at cup.tickets4fans.ca, a paid subscription service called Last Minute Deals, and accept direct deal submissions from ticket holders. By accessing or using our website, any related subdomain, any feature or game, submitting a deal, or using any of our services, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

Definitions

User: Anyone using the platform, including buyers, sellers, subscribers, players, and other visitors.
Seller: A verified season seat holder or other permitted ticket holder listing or offering tickets. Sellers may be verified for one or more teams.
Buyer: An individual looking to purchase a ticket.
Feature: Any tool, game, content experience, service, or functionality made available by Tickets 4 Fans, whether on the main site or a related subdomain.
Subdomain: Any website, microsite, or hosted experience operated by or for Tickets 4 Fans under a related Tickets 4 Fans web address, including cup.tickets4fans.ca.
Cup Pass: A Tickets 4 Fans fan-engagement baseball game or related digital feature operated on a related subdomain or feature page, intended for entertainment and fan engagement purposes.
Last Minute Deals: A paid recurring subscription service that gives subscribers access to game-day deal alerts and related notifications about available ticket opportunities.
Deal Submission: Information submitted directly to Tickets 4 Fans by a ticket holder, including through an intake form or direct outreach, for review and possible promotion through Tickets 4 Fans, including to Last Minute Deals subscribers. A Deal Submission may be made by a person who is not a registered user of the platform.

Subdomains and Related Features

These Terms apply not only to tickets4fans.ca, but also to related Tickets 4 Fans pages, subdomains, hosted experiences, and features that link to or incorporate these Terms, including Cup Pass. Unless separate terms expressly apply to a particular feature, these Terms govern your use of that feature.

We may introduce, modify, suspend, or discontinue subdomains and features at any time, including fan-engagement games, ticket tools, subscriber experiences, or promotional pages.

Modifications to Terms

We may modify these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the website, a related subdomain, or any feature after changes take effect means you accept the revised Terms.

For material changes — and in particular for material changes that affect an active Last Minute Deals subscription, such as a price change, a change to the cancellation or refund rules, or a material change to the scope of the subscription service — we will provide reasonable advance notice. For active paid subscribers, that notice will typically be given by email to the address on file at least thirty (30) days before the change takes effect, unless a shorter period is required by law or by an urgent security, legal, or compliance circumstance.

If you do not agree to a material change to your subscription, you may cancel your subscription before the change takes effect through the Stripe Customer Portal. Continued use of the subscription after a material change becomes effective constitutes acceptance of the change.

Use of the Platform

You agree to use the Website, subdomains, and related features only for lawful purposes. You must not:

List or submit fake, misleading, or non-existent tickets
Attempt to bypass, exploit, scrape, reverse engineer, or game our systems or features
Use another person's information without authorization
Post or submit abusive, offensive, deceptive, fraudulent, or unlawful content
Use automated methods to interfere with gameplay, rankings, submissions, or platform operations
Use Cup Pass or any feature for illegal, commercialized, or unauthorized promotional purposes

We facilitate contact between buyers and sellers and may share necessary personal information for the purpose of completing ticket transactions or administering our services. You consent to this when using the platform, a feature, or submitting information to us.

Account Registration and Verification

You may be required to verify your identity or season seat status for certain services. We reserve the right to reject, suspend, terminate, or decline to promote any account, listing, submission, or feature participation that does not comply with our verification protocols or other platform requirements.

Age Requirement

You must be at least 18 years old and able to enter into a legally binding contract under the laws of your jurisdiction to register an account, subscribe to Last Minute Deals, submit a deal, or otherwise transact through Tickets 4 Fans. By using the platform you represent and warrant that you meet this requirement.

Tickets 4 Fans is not directed at children and we do not knowingly collect personal information from individuals under 18. Minors may not use the platform, Cup Pass, Last Minute Deals, or any related communications channel without the involvement and authorization of a parent or legal guardian who accepts these Terms on their behalf. If we become aware that we have collected personal information from a minor without appropriate authorization, we will take reasonable steps to delete it.

AI-Assisted Operations

Tickets 4 Fans uses AI-assisted drafting tools to help operate the service, including to help draft Last Minute Deals campaign emails and other internal content. Where AI is used:

A human reviews and approves the output before any communication is sent to users
No solely automated decisions that produce binding effects (such as eligibility, account suspension, pricing for an individual, or denial of service) are made about you
AI-assisted output may occasionally contain errors; we make commercially reasonable efforts to catch them in the review step

Disclaimer – Not a Broker

Tickets 4 Fans is not a ticket broker or reseller. Except where expressly stated for subscription billing, we do not take payment on behalf of sellers or guarantee ticket delivery or event entry. Most marketplace transactions are directly between users.

Deal Submissions

Tickets 4 Fans may accept direct Deal Submissions from ticket holders, including individuals who are not registered users of the platform. We may review these submissions and, at our discretion, decide whether to publish, promote, circulate, edit for formatting, shorten for promotional use, or decline them.

By submitting a deal to Tickets 4 Fans, you represent and warrant that:

You are authorized to offer the submitted tickets for sale
The information you provide is accurate, complete, and not misleading
Your submission does not violate any law, venue rule, ticket restriction, or third-party right

Submission of a deal does not guarantee that Tickets 4 Fans will publish, promote, distribute, match, or sell the deal. Tickets 4 Fans may contact you by email, phone, or WhatsApp regarding your submission and may use deal details to communicate opportunities to Last Minute Deals subscribers or other permitted audiences, subject to our Privacy Policy.

Cup Pass

Cup Pass is a Tickets 4 Fans fan-engagement baseball game or related digital feature. Cup Pass is provided for entertainment, engagement, and promotional purposes only. Unless expressly stated otherwise in separate rules or promotions, Cup Pass does not require a purchase to play, does not require email submission to participate in gameplay, and does not create any right to receive tickets, prizes, monetary value, or any guaranteed benefit.

We may offer optional opportunities within or after Cup Pass for users to request updates about Last Minute Deals, future games, selling tickets, or Cup Pass updates. Any such marketing or update request is optional and separate from gameplay participation.

Cup Pass does not include or operate any sportsbook, cash-settlement, wagering, betting-against-the-house, or prize-pool functionality, and does not guarantee any prize, reward, ticket, or monetary value. Where Tickets 4 Fans does run a promotional contest or giveaway, separate official rules will govern that promotion.

Cup Pass is offered on a beta and experimental basis. Mechanics, scoring rules, leaderboards, rewards, eligibility criteria, and overall feature availability may be modified, paused, reset, or discontinued at any time, with or without notice.

No Gambling or Wagering

Cup Pass and any similar fan-engagement feature are not gambling, betting, wagering, fantasy sports for money, cash-settlement products, or games of chance played for cash stakes. Users may not use the platform, subdomains, or any feature to place wagers, pool money, settle bets, or facilitate gambling-related activity.

Any scoring, standings, predictions, cups, badges, streaks, or gameplay outcomes displayed in Cup Pass are for fan engagement and entertainment only unless separate official rules expressly state otherwise.

Beta, Availability, and Changes

Certain features, including Cup Pass, may be released as beta, pilot, test, limited-access, or experimental features. Such features may contain bugs, interruptions, incomplete functionality, or changes in scoring, design, rules, content, availability, or user experience.

Tickets 4 Fans may modify, suspend, reset, restrict, or discontinue any feature, leaderboard, game mechanic, scoring element, or subdomain at any time, with or without notice.

Venue and Law Compliance

You are responsible for complying with all applicable laws, regulations, venue rules, league rules, ticket terms, and event policies in connection with your use of Tickets 4 Fans and any related feature. This includes any rules relating to ticket transfers, resale restrictions, promotions, attendance, and conduct at venues or events.

You must not use Cup Pass, Last Minute Deals, Deal Submissions, or any related feature in a manner that violates applicable law or the rules of a stadium, venue, event organizer, or ticket issuer.

Force Majeure

Tickets 4 Fans shall not be liable for failure or delay caused by events beyond its reasonable control, including event cancellation or relocation, government restrictions, natural disasters, airline disruptions, acts of terrorism, labour disruptions, technical outages, service-provider outages, or pandemic-related restrictions.

In such cases, remedies shall be limited to amounts actually recoverable from third-party providers.

Last Minute Deals

Tickets 4 Fans may offer a paid recurring subscription service called Last Minute Deals. Last Minute Deals is currently priced at $5 CAD per month, plus applicable taxes (including Ontario HST where required), and gives subscribers access to game-day deal alerts and related notifications.

What the subscription includes — and what it does not. A Last Minute Deals subscription is a paid service for receiving deal alerts and related notifications. The subscription:

Does not include event tickets — tickets are obtained separately from the seller
Does not guarantee the availability of any ticket, event, inventory level, discount, seller response, or successful purchase outcome
Does not guarantee a minimum number of deals, games covered, or notifications per billing period

Ticket listings and opportunities are subject to availability and may change or disappear without notice. Deals displayed through Last Minute Deals reflect ticket opportunities sourced from verified season seat holders, Deal Submissions, or other permitted sources on the platform. Tickets 4 Fans remains a marketplace facilitator and is generally not the seller of the underlying ticket unless expressly stated otherwise.

Subscription Billing

Last Minute Deals subscriptions are billed on a recurring monthly basis through Stripe. By subscribing, you authorize recurring monthly charges to your selected payment method, including applicable taxes such as Ontario HST where required.

Billing is processed by Stripe, a PCI-compliant payment processor
Tickets 4 Fans does not store your full payment card details locally
Your subscription automatically renews unless cancelled before the next billing date
We may change subscription pricing in the future with reasonable prior notice

Continued use of the subscription after a pricing change takes effect constitutes acceptance of the updated price.

Subscription Cancellation & Refunds

You may cancel your Last Minute Deals subscription at any time through the Stripe Customer Portal. There are no cancellation fees.

Unless required by applicable law, cancellations take effect at the end of the current billing period. You will continue to have access to the subscription service until the end of that paid period.

Payments already made are non-refundable, and we do not provide partial-month or prorated refunds unless required by law or expressly stated otherwise.

Subscription Communications

By subscribing to Last Minute Deals, you provide express consent to receive communications related to the subscription and the service, including:

Game-day deal emails
Subscription-related transactional emails
Future SMS or WhatsApp messages about deals, where such channels are activated

Each commercial electronic message will include an unsubscribe mechanism in accordance with applicable law. Subscription-related transactional messages may still be sent where necessary to administer your account, billing, or the service.

User Responsibilities

Users and submitters are responsible for:

Ensuring ticket, gameplay, and deal details are accurate and up to date where submitted by them
Being authorized to sell or submit the tickets described
Honoring agreed-upon terms with the other party
Providing accurate subscription and contact information
Using features, subdomains, and fan-engagement tools lawfully and fairly

Tickets 4 Fans is not liable for refunds or disputes unless stated otherwise in these Terms or required by law.

Fees and Payments

Our marketplace platform is currently fee-free for standard fan-to-fan use unless otherwise stated. We reserve the right to introduce service fees, subscription fees, or other charges in the future with appropriate notice.

Prohibited Activities

You may not:

Engage in ticket scalping in violation of local laws
Use the site to launder money or commit fraud
Interfere with or disrupt the platform's functionality
Collect data from users without consent
Scrape, crawl, harvest, index, or otherwise extract content, listings, deal alerts, subscriber information, gameplay data, or pricing from the platform or any subdomain by automated means
Use bots, headless browsers, automation frameworks, or scripts to access, monitor, abuse, or interact with the platform, Last Minute Deals alerts, Cup Pass, or related features
Create, operate, or maintain fraudulent, duplicate, impersonating, or sock-puppet accounts, or use another person's account or contact information without authorization
Redistribute, resell, forward in bulk, republish, or otherwise commercially exploit Last Minute Deals alerts or other subscription-only content outside your personal use
Misuse subscription content, alerts, or communications for unauthorized commercial, advertising, or competitive-intelligence purposes
Submit false, unauthorized, deceptive, or unavailable deals
Manipulate Cup Pass mechanics, scoring, leaderboards, predictions, or any related feature, including by exploiting bugs, multi-accounting, automation, collusion, or coordinated activity
Circumvent or attempt to circumvent rate limits, authentication, access controls, paywalls, geo-restrictions, or other technical or contractual restrictions on the platform
Use Cup Pass or any related feature for wagering, betting, or unlawful prize activity

Termination of Access

We reserve the right to suspend or terminate user accounts or subscriptions, refuse or remove Deal Submissions, restrict access to Cup Pass or any related feature, and limit platform access for violations of these Terms, applicable law, fraudulent activity, abuse of the platform, or misuse of Last Minute Deals or fan-engagement features.

Where a seller account is suspended, all of that seller's active listings will be hidden from public view and seller communications paused for the duration of the suspension. Suspension is reversible and does not delete the seller's data; access and listings may be restored if the suspension is lifted.

Intellectual Property

All trademarks, content, branding, game content, scoring displays, deal alerts, and related materials on this site or any related subdomain are owned by or licensed to Tickets 4 Fans. You may not use, reproduce, distribute, or exploit any content without our written consent.

Disclaimers

The platform and all related services, including subdomains, Cup Pass, Last Minute Deals, and Deal Submissions, are provided “as is” without warranties of any kind. We do not guarantee continuous availability, error-free operation, uninterrupted alerts, uninterrupted gameplay, publication of submitted deals, or successful ticket acquisition through the platform or subscription service.

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of the platform, any related subdomain, any interaction between users, any Deal Submission, any use of Cup Pass, or any use of Last Minute Deals.

Liability cap. Subject to applicable law, Tickets 4 Fans' total aggregate liability for all claims arising out of or relating to the marketplace, Last Minute Deals, Cup Pass, Deal Submissions, or any other Tickets 4 Fans service shall not exceed the greater of (a) CAD $100 or (b) the total amounts paid by you to Tickets 4 Fans in the twelve (12) months preceding the event giving rise to the claim.

For Last Minute Deals, Cup Pass, and Deal Submissions, Tickets 4 Fans is not liable for unavailable inventory, expired offers, seller conduct, failed transactions, rejection of submitted deals, notification delays, gameplay interruptions, scoring changes, feature removal, or missed purchasing opportunities.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable consumer protection or other mandatory law.

Indemnity

You agree to indemnify and hold harmless Tickets 4 Fans from any claims, disputes, losses, or liabilities arising from your actions, submitted deals, misuse of the platform, misuse of subdomains or features, subscription misuse, or violation of these Terms.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada. Any disputes shall be resolved in the courts of Ontario, unless otherwise required by applicable consumer protection law.

Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remainder shall remain in full force and effect.

Entire Agreement

These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Tickets 4 Fans regarding your use of the website, related subdomains, and services.

Last Minute Deals, Deal Submissions, Cup Pass, and related subdomains or features are distinct from the core fan-to-fan marketplace and do not alter the fundamental marketplace structure except as expressly stated.
